Well after a n amour of furious googling it would appear the factory gasket is reusable... I've lost the link but apparently Mazda/cpe & ken from pg all said that gasket replacement isn't necesary

you shouldnt have any problems with re-using the factory gasket

i am pretty sure most people in australia who replaced the downpipe would have reused the gasket because mazda wanted $130 plus gst for the part if i remember correctly, and that is trade price

otherwise its around $170 for retail price

just make sure the studs are done up tight and you will be fine

If you haven't damaged it when taking off the OEM downpipe you can re-use it. Don't
Don't stick a screwdriver into the flange gap to lever off the DP as you might damage the gasket.
Be real careful to torque up the flange nuts properly.
One of them on the CP-E DP is a bitch to get at and apply enough torque.
Mine was re-used and is fine after 10,000km.
