Needs recirc, although dual port BOV's are available that recirc in low boost situations and partially VTA under high boost while maintaining the recirc.
Turbosmart dual-port BOV is a good example:

The HKS SSQ that I have can run full VTA without misfire/hiccup or CEL. Some MPSs will pop/fart when running 50/50 and some when 100% VTA. It's not legal in any state. You are better of running re-circ and getting a decent SRI that allows the sound to be audible through the filter.

Dunno how it goes, a quick Google might turn up some answers. From memory it's a bit expensive...there's probably better ways of spending your hard earned $.
Edit: That's the electronically adjustable one right?

Yes, the Deceptor Pro is basically a hybrid GT with an electric motor to control the amount of vent/recirc.
